Terms of Service

1. Scope

These Terms of Service apply to the use of the platform zcroll (hereinafter "Platform"), accessible at zcroll.com and zcroll.to, operated by zcroll (hereinafter "Operator").

By registering on the Platform, the user accepts these Terms of Service. Deviating conditions of the user are not recognized unless the Operator expressly agrees to their validity in writing.

2. Service Description and User Groups

zcroll is a free link-in-bio platform with an integrated advertising and compensation system. The platform distinguishes three user groups, each with different functions and rights:

A user can be both an Earner and a Promoter simultaneously. The basic use of the platform as a User is free. The platform reserves the right to expand or restrict the range of features at any time.

3. Registration and User Account

Registration is required to use the platform. Registration can be done via email/password or through social login services (e.g., Google). The user agrees to provide truthful information during registration and to keep it up to date.

• Each user may only have one account.
• Login credentials must be kept confidential.
• The user is responsible for all activities under their account.
• Registration is only permitted from the age of 16.

4. Provisions for Users

The following provisions apply to all registered users of the platform.

4.1 Profile and Links

Users can create a public profile page accessible via a personalized URL. Any number of links to external content can be added to this page (e.g., social media profiles, websites, online shops, videos, music).

• Users can customize their display name, bio, profile picture, and banner image.
• Links can be organized into groups and individually named.
• Users can create shortlinks that can be shared anywhere without appearing on the profile.
• Themes and color schemes are available for profile customization.

4.2 Interstitial Ads

When a visitor clicks on a link, a short advertisement (interstitial) may be displayed before redirection to the target URL. The duration of the ad varies by ad type. This model allows the platform to remain free and to pay Earners compensation.

5. Provisions for Earners

The following provisions apply to users who have activated the Earn feature and participate in the compensation program.

5.1 Compensation Model

Earners receive compensation based on verified ad impressions (views) generated through their links. Compensation is on a CPV (Cost Per View) basis.

• The revenue share is 70% of net advertising revenue for the Earner and 30% for the Operator.
• During the launch phase, the Operator may offer a different revenue share (up to 100% for the Earner).
• Compensation is based on the actual CPV achieved and may vary by campaign, category, and ad format.
• There is no entitlement to a specific minimum or guaranteed compensation.

5.2 KYC Verification

Participation in the compensation program requires successful KYC (Know Your Customer) verification. This is legally required and includes the following data:

• Full name
• Date of birth
• Residential address
• Valid identity document

No payout is possible without completed KYC verification.

5.3 Payouts

• Payouts are made via Stripe Connect to the bank account provided by the Earner.
• The minimum payout threshold is EUR 25.00.
• Payouts can be requested via the dashboard once the minimum amount is reached.
• The Operator is not liable for delays caused by the payment service provider.
• All amounts are in EUR.

5.4 Ad Categories

Earners can specify in their settings which ad categories may be displayed on their links. Certain categories (e.g., NSFW, Dating) can be specifically allowed or blocked. The Operator does not guarantee that advertising in the desired category will be available at all times.

6. Provisions for Promoters

The following provisions apply to users who have activated the Promote feature and place advertisements on the platform.

6.1 Creatives and Campaigns

Promoters can upload advertising materials (creatives) in the form of images (JPG, PNG) or videos and create campaigns. All creatives go through a review process by the Operator before going live.

• A creative can only be used in a campaign after it has been approved.
• The Operator reserves the right to reject creatives without stating reasons.
• Upon rejection, the Promoter will be notified with the reason and can revise and resubmit the creative.

6.2 Budget and Billing

• Promoters pay on a CPV basis (Cost Per View) - only verified ad impressions are charged.
• Budget is pre-loaded via Stripe Checkout.
• A daily budget and total budget are set per campaign.
• Spent budget is non-refundable.
• The Operator reserves the right to deactivate campaigns that violate guidelines without refund.

6.3 Targeting

Promoters can target their campaigns by Earner categories and content type. Advertisements are shown to users who interact with relevant Earner content. The Operator does not guarantee a specific reach or impression count.

6.4 Advertising Guidelines

The following content is not permitted as advertising material:

• Illegal content or products
• Misleading or fraudulent advertising
• Pornographic, violence-glorifying, or discriminatory content (outside of appropriately labeled NSFW categories)
• Advertising for weapons, drugs, or tobacco
• Content that infringes on third-party copyrights
• Malware, phishing, or other harmful content

7. Obligations of All Users

Regardless of user group, every user commits to:

• Not publishing any content that violates applicable law.
• Not performing automated clicks or other manipulations to increase advertising revenue (click fraud).
• Not using the platform for spam, fraud, or other abusive purposes.
• Not using third-party content without their consent.
• Not employing technical measures to circumvent the platform's security mechanisms.
• Appropriately labeling NSFW content.

8. Fraud Prevention

The Operator employs technical measures to detect fraudulent activities (e.g., bot traffic, click fraud, artificial click generation). In case of suspected fraud, the Operator reserves the right to:

• Freeze suspicious earnings
• Temporarily suspend the user account
• Permanently delete the user account
• Void accumulated balances
• Deactivate running campaigns without refund

9. Liability

The Operator is only liable for damages caused by intentional or grossly negligent conduct. Liability for slight negligence is excluded unless essential contractual obligations are violated.

The Operator assumes no warranty for:

• Uninterrupted availability of the platform
• Specific revenue levels for Earners
• The reach or success of advertising campaigns for Promoters
• Content provided by users on the platform

10. Termination and Account Deletion

The user may delete their account at any time. The Operator reserves the right to terminate user accounts without notice in case of violation of these Terms of Service.

Upon termination or account deletion:

For Earners

• Balances above the minimum amount of EUR 25.00 will be paid out, provided valid KYC verification exists.
• Balances below the minimum amount are forfeited.
• The Earn feature will be deactivated; ongoing earnings will cease.

For Promoters

• Running advertising campaigns will be stopped immediately.
• Unspent budget can be refunded within 30 days of termination.
• Already spent budget is non-refundable.

For All Users

• The public profile and all links will be deactivated.
• Personal data will be deleted in accordance with the Privacy Policy.

11. Intellectual Property

All rights to the platform, including design, code, and trademarks, belong to the Operator. The user grants the Operator a simple, non-exclusive right of use to the content uploaded to the platform, to the extent necessary for the operation of the platform (e.g., displaying profile pictures, showing creatives in advertising campaigns).

12. Changes to the Terms of Service

The Operator reserves the right to change these Terms of Service at any time. Changes will be communicated to the user by email. If the user does not object to the changes within 30 days of receipt of the notification, the amended Terms of Service are deemed accepted.

13. Final Provisions

• The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.
• The place of jurisdiction, to the extent permitted by law, is the registered office of the Operator.
• Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions shall remain unaffected.
